Records:  Statement of Policy:

Pursuant to Ohio law and regulations, the family and children records of public children service agencies are strictly private and confidential.

Fundamental Rule:The privacy of these records is protected by Ohio law and Ohio Supreme Court decisions.1.      They are not public records under RC 149.43.2. They are not open to disclosure under the Personal Information Systems Act, RC Chapter 1347.3.The Ohio Supreme Court Decision, Renfro, 54 Ohio St. 3d 25 (1990) sets forth that family and children records are private and confidential.

Confidentiality:Confidentiality is vital to the work of a Public Children Services Agency.  To effectively perform its duties of protecting children, an agency must assure the public of its ability to maintain confidential information.  The agency’s work depends upon the client’s willingness to make honest and open disclosures of personal information.  Likewise, the agency depends upon the community to report suspected abuse and neglect of children.  A public children services agency can hardly expect to be successful if there is any reckless disregard of confidential information.  Therefore, information is carefully guarded as a matter of law, as a matter of professional ethics and as a matter of good child welfare practice.  Anyone who permits or encourages the unauthorized disclosure of confidential information is in violation of Ohio Law, a fourth degree misdemeanor.

Purpose of the Policy:The purpose of this policy is to protect the privacy of information about persons served and to ensure that any release of confidential information serves the best interest of the child and complies with all legal requirements.  This policy governs the handling of all agency confidential records including, but not limited to, children currently or previously in agency custody, current clients, former clients (living or deceased), adopted individuals, adoptive family members and foster care providers.
